Copyleft o la propiedad compartida

Durante mis estudios en la universidad recordaré siempre un nombre: Chippolla. Historiador italiano cuyos libros tuvimos que memorizar durante mi curso de Historia Económica, gracias a la desfasada metodología de estudio de la facultad de Económicas de Barcelona. Recuerdo en concreto este autor por las letras de cambio. Había una frase que más o menos decía algo parecido a esto: "La aparición del concepto de la propiedad privada marcó el inicio del capitalismo como sistema económico, político y social".

Este recuerdo me vino a la cabeza después de investigar por mi cuenta algo que creo que es una tendencia muy interesante por las implicaciones que puede tener sobre nuestra sociedad. Se trata del concepto de Copyleft. La idea es simple: cuando yo creo algo tengo todos los derechos sobre mi creación. El concepto de copyleft es que yo cedo parte de estos derechos en beneficio que otros disfruten de mi obra, o incluso que así fomento que otros hagan lo mismo con sus creaciones.

El copy left surge a partir de la necesidad de crear nuevas normas alrededor de las creaciones digitales. Debemos de tener en cuenta varios elementos:
  1. Todo aquello que es digitalizable es suseptible de ser copiado.
  2. Con la introducción de las tecnologías de la información en la sociedad, todos los usuarios de estas se convierten en parte creadora. Somos 'generadores' de obras digitales, independientemente del valor que le asignemos, por lo que somos los propietarios de ellas y podemos definir qué derechos concedemos a los usuario de las mismas.

A partir de ahi entramos en las diferentes categorías de derechos que podemos encontrar:
  • La cesión de todos los derechos de mi obra: hacer lo que queráis que nunca pediré nada a cambio.
  • Ceder los derechos de mi obra, siempre y cuando me cites y me digas que he sido la fuente.
  • Ceder mi obra pero no la puedes modificar ni alterar para hacer derivados de ella.
  • Ceder mi obra siempre y cuando no sea utilizada para usos comerciales
  • Ceder mo obra siempre que lo que hagas con ella se encuentre bajo los mismos derechos. Es decir que si se altera o transforma la obra, o genera una obra derivada, sólo se podrá distribuir la obra generada bajo una licencia idéntica a ésta.

Las implicaciones que tiene el CopyLeft son grandes:
  1. Estamos empezando a desglosar los derechos derivados de obras. Os imagináis comprar un cd y que venga escrito: te dejo que se lo grabes a tus amigos y hagas recopilaciones con las canciones de este CD, pero sobre todo, no lo utilices en fiestas de más de 200 personas. :S
  2. Distigue claramente entre Consumidores (existe un uso comercial detrás de la utilización de la obra) y usuarios (disfrutan de la obra, como tal sin querer darle extraer un rendimiento económico de este uso)
  3. Existe una descentralización de la gestión de los derechos nacionales y se tiende entonces a centralizar en una organización como CREATIVE COMMONS. Cada país tiene una agencia que gestiona los derechos de los autores (p.e. la polémica SGAE en España), pero en el universo de las obras digitales resulta muy complejo para una gestión nacional por lo que se genera un cambio de centralización.
